1. About these terms
These terms govern your use of zaryacloud.com (the “website”). zaryacloud is a brand of Thynkwise Advisors Private Limited, GSTIN 27AAKCT9800G1Z3, Flat 406, Star Gaze, 17/10/1/57, Dhanori, Lohegaon, Pune, Maharashtra 411015, India (“we”, “us”). By using the website you agree to these terms. If you use it on behalf of an organisation, you confirm you may accept them for it.
2. Services are provided under a separate contract
The website describes our GPU and CPU cloud, colocation, hardware, software and infrastructure services. Any service we provide is governed by the written quote, order form or agreement we sign with you (the “contract”). If the contract and these terms differ, the contract applies.
3. Prices and quotes
- Prices on the website, in the calculator and in the GPU advisor are indicative list prices to help you plan. They exclude taxes unless shown otherwise.
- Rupee amounts are converted from US dollars at the rate shown on the website and are for guidance only.
- Prices, specifications and availability can change and depend on region, quantity, term and supplier capacity. A price is only binding when it appears in a written quote or contract from us.
- Written quotes are valid for the period stated on them, or 15 days if no period is stated.
4. Information on the website
We work to keep the website accurate, but content such as guides, specifications, benchmarks and advisor recommendations is general information, not professional advice for your situation. We confirm the right configuration with you before you buy.
5. Acceptable use
You must not use the website or our services to break any law; infringe anyone’s rights; send spam; attack, probe or overload our systems or anyone else’s; host or distribute malware or illegal content; or mine cryptocurrency without our written agreement. We may suspend access that breaks these rules. More detailed rules may apply under your contract.
6. Intellectual property
The website, its text, design, illustrations and the zaryacloud name and logo belong to us or our licensors. You may view and share pages for your own business evaluation, but not copy or reuse the content for other purposes without our permission. NVIDIA, GPU model names and other product names are trademarks of their respective owners and are used only to describe products; their use does not imply endorsement.
7. Forms and communications
When you send a form, you confirm the information is accurate and that you may share it. We use it as described in our Privacy Policy. Sending a form does not create a contract.
8. Third-party links
The website may link to other websites, such as LinkedIn. We are not responsible for their content or practices.
9. Liability
The website is provided “as is”. To the extent the law allows, we are not liable for indirect or consequential losses, or for loss of profit, revenue or data, arising from your use of the website. Our total liability for any claim relating to the website itself is limited to ₹10,000. Liability for services is set out in your contract. Nothing in these terms limits liability that cannot be limited by law.
10. Governing law
These terms are governed by the laws of India. The courts at Pune, Maharashtra have exclusive jurisdiction, subject to any mandatory rights you have where you live.
